BALKAN MARATHON

Participation and Travel Terms

Before the trip

Motorcycling is not a risk-free hobby. Different riding conditions and situations should be expected, especially in unfamiliar countries. A helmet, gloves, motorcycle boots, and a jacket and trousers with protectors are essential for your protection. Suitable clothing and attentive, appropriate riding reduce the risk of injury. Anyone unwilling to accept the remaining risk should not ride a motorcycle.

Short-notice changes to the itinerary may be necessary because of timetable changes, severe weather, accidents, illness or technical problems. Participation in day tours is voluntary, taking your condition on the day into account, and is at your own risk. The tours are not suitable for people with reduced mobility.

1. Conclusion of the travel contract

By registering for a trip, the traveller makes a binding offer to enter into the travel contract. The basis of the contract is the trip description and any supplementary information and service descriptions. Bookings may be made in writing, verbally, by telephone or by email. The contract is concluded when the acceptance notice is received.

At or promptly after conclusion of the contract, the traveller receives a confirmation containing the key details of the booked travel services. As a rule, there is no right of withdrawal for package travel contracts concluded at a distance; statutory rights to cancel or terminate apply.

2. Payment and insolvency protection certificate

A certificate protecting customer payments is provided together with the travel confirmation. Upon conclusion of the contract, a deposit of 30% of the travel price is due; for trips to Southern Europe, the deposit is 500 euros. It must be paid within seven days of receiving the confirmation and invoice. The remaining balance is due no later than 28 days before the trip begins.

If payment is not made, the tour operator may withdraw from the contract after issuing a reminder and setting an additional payment deadline, and may claim the agreed cancellation charges.

3. Services and changes to services

The agreed services are set out in the description of the relevant tour, the trip announcement and the travel confirmation. We reserve the right to make non-material changes that become necessary after the contract is concluded and do not alter the overall nature of the trip. Tour descriptions are proposals; external, safety-related or organisational reasons may make changes necessary.

The traveller will be informed of changes without undue delay. In the event of a material change, the traveller may accept it, withdraw from the contract without charge or choose an offered replacement trip.

4. Traveller's withdrawal before the trip begins

The traveller may withdraw at any time before the trip begins. Notice must be given to the tour operator; written text form is recommended. In the event of withdrawal or failure to join the trip, reasonable compensation may be charged unless the withdrawal is the operator's responsibility or extraordinary circumstances apply.

The fixed charges stated in the source terms are: up to the 60th day before departure, 20%; from the 59th to the 45th day, 50%; from the 44th to the 29th day, 70%; from the 28th to the 19th day, 85%; from the 18th to the 9th day, 90%; and from the 8th day until departure, or in the event of failure to join, 95% of the travel price. The traveller may provide evidence that no loss, or a smaller loss, was incurred.

The tour operator recommends taking out travel cancellation, trip interruption, travel accident and international health insurance.

5. Withdrawal and termination by the tour operator

If the stated minimum number of participants is not reached, the tour operator may withdraw up to the 29th day before the trip begins. The operator may also withdraw before departure due to unavoidable extraordinary circumstances. In these cases, payments made will be refunded within the statutory period.

The tour operator may terminate the contract without notice if, despite a warning, the traveller fails to follow instructions, seriously disrupts the trip or endangers the group's safety. This also applies if the vehicle, equipment or driving licence does not meet the requirements.

6. Changes to bookings and replacement travellers

After conclusion of the contract, there is no entitlement to changes to the travel date, destination, accommodation, provision of a vehicle or type of transport. Subject to availability, changes may be made up to the 31st day before departure against reimbursement of the resulting costs plus a service fee of 45 euros.

The traveller may name a replacement person within a reasonable period. The tour operator may object if that person does not meet the contractual travel requirements. A processing fee of 25 euros may apply; proven additional costs are reserved.

7. Assistance and travel defects

If problems arise, the tour operator will provide reasonable assistance. Defects must be reported without undue delay to the tour operator or tour guide so that they can be remedied. The tour guide is not authorised to acknowledge claims.

If a package trip is materially affected and no remedy is provided within a reasonable period, the traveller may terminate the contract in accordance with statutory provisions.

8. Traveller's obligations

The traveller is responsible for getting to the tour independently unless this is included in the offer. The traveller must arrive at the tour start on time and bring a roadworthy, registered vehicle, the required safety equipment and a valid driving licence.

Relevant chronic health conditions must be disclosed confidentially to the tour operator or tour guide no later than the start of the tour. The traveller bears additional costs arising from missing equipment, lateness or failure to meet participation requirements.

9. Risks of motorcycle tours and liability

Motorcycle tours involve a risk of accidents and injury that cannot be completely eliminated, even with protective clothing and careful planning. Every participant rides on their own responsibility and follows the group riding rules.

The traveller must comply with applicable traffic rules, adapt their riding to their ability and local conditions, and is responsible for violations and any resulting damage. Liability is governed by statutory provisions and validly agreed travel terms.

10. Passport, visa, customs and health requirements

The tour operator provides general information about passport and visa requirements and health formalities. The traveller is responsible for complying with the requirements relevant to the trip and ensuring that their travel documents remain valid for the required period.

11. Provision of a motorcycle

For a vehicle provided by the tour operator, the source terms state an excess of 1,000 euros for comprehensive damage. In the event of an accident, the vehicle user is also responsible for the excess and for towing and recovery costs. The contractual terms of the relevant cooperation partner apply to vehicles provided by a partner.

12. Data protection and image rights

Personal data is processed where necessary to perform the contract. Travellers' names or photographs may be published only with their express consent. Consent is voluntary and may be withdrawn at any time.

13. Copyright

GPS tracks, routes and tour suggestions are the intellectual property of the tour operator. Recording, publishing or commercial use requires the operator's prior consent.

14. Consumer dispute resolution

The tour operator does not participate in dispute resolution proceedings before a consumer arbitration board and is not obliged to do so.

15. Invalidity of individual provisions

If any provision of these travel terms is or becomes invalid, the validity of the remaining provisions and of the travel contract as a whole remains unaffected.
